07 “I’ve got you now, you’ve made a fatal mistake”

Perverting the course of justice. 3

In late 1991 Donald Britton contracted to sell his farm property at Makirikiri Valley, Wanganui to my wife Sandra. Then he changed his mind about selling and tried to get out of the deal by intimidation.

On January 7 1992 Donald Britton said these things to me outside my fathers place in Wanganui. All on tape.

Britton “Jack, at the moment I’m in a fairly stable frame of mind, not every third day I’m not, every third day I’m fucken”….

Jack “That’s not my problem.”

B “Nothing’s your problem at the moment, until this goes ahead, until it actually takes place. If this sale goes ahead, then it will be your problem.”

J” Why?”

B” Oof, fucken hell, fucken, it just will be. I fucken, listen I know, I fucken know, I don’t fucken sleep at night, I know right?

J” What, you’re going to get violent?”

B” Oh fucken hell man, I don’t know myself. The money doesn’t mean anything to me so I’ll spend it real easy and real quick, this money doesn’t mean anything to me. (Is he hinting that he’ll hire a hitman?) From here on I honestly do not know…what I’m like because I fucken spend a lot of fucken sleepless nights and all sorts of fucken shit, right. If anyone dies you’ll go to hell. If you take my land off me you’ll die on the place, you and your family will die on the place. You’ll not survive January.” (Remember his avarice is exceeded by nothing, not even his sexual perversions.)

The police (McGillivray/Haggart) refused our request to remove Britton’s firearms from him at this time saying that we were probably trying to use them to further our civil claims. (Our Specific Performance proceedings.)

Then On March 19, minutes before he signed the Transfer, he said this, “I’ve come that fucken close to fucken suicide about five times over the last couple of months and about that fucken close to murder. It can’t be good for me. I can’t get past that state when I’m in that state. Look I laugh sometimes and the next minute I’m crying so I’m not sure.” (Guess who he wanted me to think would be the murder victim.)

Then during the period March 19 to May 19 (After the sale went through.) Britton said these things to me at the Makirikiri farm.

“You know I poured Roundup on the roof, only to kill the moss though. Ha, Ha, Ha.”

“See that tree there it’s shaking, that’s a bad omen.”

“You know this house is built on a fault line.” (Referring to our house.)

“I caught two poachers on my land one day and I made them beg for their lives. I had my gun and a shovel with me. I made one of them start to dig a grave and then I told them to fuck off. I had Mike O’Keefe with me.”

“I punched Hugh Speed in the face on the boundary fence one day. Mike O’Keefe was with him and he told me later that he thought I’d lost it.”

“I fired a shot near a bloke on James’ one day. He told Alan James that he was going to tell the cops about it but Alan James advised him not to because I would get him back.”

“I’d like to be shot in the thigh with a high powered rifle just to see what it feels like.”

“I’ve been very lenient with you.”

“I’m a fucken schizophrenic are you worried?”

“I got my (rifle) barrel fixed.”

“When Maryanne left me I nearly shot myself, fuck it was a close thing.”

“Tom’s my puppet, he’ll do anything for me.”

19 May 1992

“Yeehaa, I’ve got you now, I’ve got you now, you’ve made a fatal mistake. Donald Britton.

Those words were gleefully shouted at me when Britton discovered the bullet holes in his vehicle.

Senior Sergeant Nigel McRae got the sequence of the shots back to front and the ‘dispute’ was not about property.

Had McGillivray removed Britton’s firearms from him as we had requested the above would not have occurred?

I fired on the vehicle because of Britton’s threats and the fact that he carried a firearm in his vehicle whenever he came to our property.

And what did the cops charge Britton with? Trespass! It should have been Disorderly behaviour likely to lead to violence, threatening to kill, being unlawfully in an enclosed yard and making a false statement to Police, but no they charged him with the bare minimum and then advised him to tell the judge that he had to do it because it was an emergency. (Constable Cullum McGillivray)

As he left the scene he did a hand stand and walked on his hands a short distance. Mad as a snake!

  1. You fired on a moving vehicle indicating you pointed a loaded firearm at people and pulled the trigger. People like you need to be put away - no wonder the cops are on your back all the time. Drugs, burglaries, firing guns at people in Northland, firing guns at people in Wanganui. All your website does is show how unstable you are - you need to be locked away.

  3. Firing at a vehicle? You could have killed someone… it doesn’t matter how annoyed this guy made you - reasonable stable people don’t shoot at people and vehicles. I think this is a valuable insight into WHY the police aren’t your bestest buddies in the world.

    Anyway the jury thought I was justified in shooting. See 12 The Trial.


  5. Death threats - are just that - words. A gun has real bullets that can really hurt people - imagine if you had killed him - you would have gone to prison and your wife and children would have been left - its not fair to do that to a family.

    A jury also let OJ Simpson off with murder…

  7. With obvious intention. Example: “I could just kill you” is a fairly common expression - its not taken seriously because there is no clear intent. I had a problem similar to this with a girl I was working with once - she was appallingly incompetent anyway, but we were all surprised to hear that one of our sponsors was “threatening legal action” because he advised us that he had had his lawyer look at this contract - which was what she had advised management.

    Still doesn’t justify shooting his car.

If you read it again you will see that he threatened to kill my entire family more than once, swung a steel standard at the wife and pretended to throw it at her while saying I’ll get you and then threw a rock which hit her departing car. He then comes out to my place breaks through a locked gate and again threatens to kill me. What am I supposed to do, shower him with roses? Your example is pathetic.

    The jury thought my actions were justified, are you saying they got it wrong?


  9. If you cant defend your family and the piece of land you call home, you havent got a hope in hell of giving your kids a decent future. When some moron claiming to have a mental illness takes up a conversation (of sorts) which includes killing you and your children, you either call the police or defend yourself the best you are able to. I shit you not, if some spacehead claiming to be a schizophrenic told me that - he’d be pushing up daisies.

  18. I think thats an interesting situation. Not sayin you did the wrong thing, not sayin you did the right thing. I wasn’t there, I was not in your situation. We should all recognise the fact that when LOOKING at a situation we say we would deal with it differently than if we FACED it ourselves.
    I think that you probably could have handled it better. I’m guessing here but I think the shots where intended to intimidate NOT KILL. What was the distance of the vehicle?


  19. About 75 meters. I asked the cop on 111 what I should do and all he suggested was that I lock the house.


  20. Jack, I just have to wonder whether you and your wife may have brought this upon yourselves. Yes, I understand that once a contract is signed that the vendor is meant to follow through on his word, but did you ever consider that he might have had a good reason for renegging on the deal. That perhaps, he came to his senses and did not want to move away from his home, etc. You know, if it were me, and I had signed a sale of agreement contract to buy a property and the same folks had lived in it for years on end and then they decided against the move, I personally would not go through with the sale and feel like I am ousting someone out of their home that they don’t want to move away from, do you know what I mean, I suppose this really does depend on your moral outlook? Was securing that property really worth the hassle? But other than this, his barrage of harrassment and threats was uncalled for, and that the police were deafened to you sounding the alarm re his death threats was unethical on their part. I must add, keep up the good work, the cops need to be policed more actively by civilians. Are you aware of any organisations that is devoted to this stuff you do? It might be worth looking into if you haven’t done this as yet, as you need all the reinforcement you can get.

    1 Britton listed his property for sale with Elders Real Estate prior to ringing and offering it to me at a higher price.

    2 After he signed the contract and accepted the deposit and a further 4 plus grand from me to clear his mortgage I reduced the price on my property by 20 grand for a quick sale.

    3 Britton cancelled the deal AFTER I had contracted to sell my property at a further reduced price. He refused to make up what would have been my losses so I had to force the issue.

  29. well, im thinking that u and ur lady have taken advantage of the so called friendship you once had with britton,, and that u used his tempermental behavior of aggressive outbursts to manipulate your plan to purchase the land, to your advantage..
    and by what ive been reading , your just as loose as britton..
    so, i picture you laughing all the way to the bank now the value of that land would be milli dollars,that you once traded for beads!!
    and all i can say is i hope britton didnt top himself becos of you.. and that hes moved on to better brighter things..


  30. Well you thought wrong sharlene, selling the land was all his idea, he even listed it with a land agent for sale. It was only after the contract became unconditional and his cunning plan to screw me out of our deposit came unstuck that he resorted to intimidation in an attempt to get out of he deal. Your sympathies are misplaced sharlene. Britton was always the aggressor and manipulator and if you call riding his horse round town in a drunken state ‘better brighter things’ then ‘he’s moved on’ alright.
